This Privacy Policy explains how Own It Sports (“OIS,” “we,” “us”) collects, uses, stores, and protects personal information when you (a) book sessions through our website, (b) access galleries and place orders, or (c) contact us for support.

Own It Sports may send transactional SMS notifications from 833-518-3966, including gallery notifications, ordering deadlines, banner selections, product pickup notices, and similar service-related updates.

This automated number is not monitored for customer communication.

1) What We Collect

1.1 Information you provide through our website (booking/forms)

When you book or submit information on our website, we may collect:

Parent/guardian name and basic contact information
Child’s name
Grade level and/or sport participation details
Phone number (sometimes requested and may be optional depending on the form)

Website security: our website is HTTPS-secured.


1.2 Information you provide through galleries/orders

When you access a gallery or place an order, we may collect:

Account/login information (if applicable)
Billing and shipping address (for orders)
Order details, purchase history, and download activity
Messages you send us related to support or corrections


1.3 Information we may receive from programs (schools/leagues/organizations)

To organize galleries and distribute access appropriately, OIS may receive limited information from the program (for example: athlete name, team, grade, roster grouping, or access-code distribution details).


1.4 Technical data and device information

When you use our website or galleries, service providers may automatically collect technical and usage data such as:

IP address
device/browser type
session activity (pages visited, cart actions, etc.)


2) Why We Use Your Information

We use personal information to:

schedule sessions and provide customer support
organize galleries and deliver access
process orders, deliver downloads, and fulfill print products
respond to questions, corrections, and order issues
send transactional service notifications related to galleries, orders, and products
prevent fraud, misuse, and unauthorized copying of proofs
maintain business records required for accounting/tax and operational integrity


3) Payments and Processing Security

We offer multiple payment options on our website and/or in the gallery checkout. Payments are processed through secure third-party payment providers using their checkout systems. OIS does not store full payment card numbers on our servers.


4) Gallery Platforms, Face Recognition, and Proof Protection

Own It Sports uses third-party gallery platforms to host image galleries, manage access codes, deliver downloads, and process orders. Currently, galleries are hosted through PhotoDay.

Some galleries may use PhotoDay FaceFind, a facial recognition tool that helps customers locate photos of a specific athlete by comparing facial features within the gallery.

This biometric processing is performed by the platform provider solely for image search functionality within the gallery. Own It Sports does not create or maintain independent biometric databases and does not use facial recognition technology outside the functionality provided by the gallery platform.

Preview images may also include watermarks, platform screenshot deterrence measures, or other proof-protection tools designed to discourage unauthorized copying or distribution.

Own It Sports may also use additional proof-protection services such as SnapShield or similar technologies in the future.

These protections apply to preview images only. Purchased digital downloads and printed products are delivered clean.

5) Who Receives Information (Disclosures)

OIS does not sell your personal information and does not provide website-booking information to third parties for marketing or unrelated purposes.

We share information only as necessary to operate and fulfill services, including with:

Gallery and commerce platform providers (such as PhotoDay)
Payment processors (to process transactions)
Professional print labs (to produce physical products)
Shipping carriers (to deliver physical products)
IT/hosting and security providers (to maintain site reliability and prevent abuse)

We may also disclose information if required by law, court order, or to protect our legal rights.


6) Social Media and Online Presences

OIS may maintain an online presence on social platforms (for example, to share information about services and communicate with customers). Social networks generally process personal data for their own purposes (such as analytics and advertising), which may include the creation of user profiles and the use of cookies or identifiers.

We do not control how social platforms process data once you leave our site; please review the privacy policies of the applicable platforms.

OIS retains information only as long as needed for legitimate business purposes.

Website booking/calendar intake data: OIS deletes booking/calendar intake information from our server systems once sessions are completed as part of our normal workflow.

Order/transaction records: We retain the minimum necessary purchase records required for accounting/tax compliance, dispute resolution, and business documentation.

Retention periods can vary depending on the type of record and applicable legal obligations.


9) Data Security

We use reasonable administrative and technical safeguards to protect personal information. No online system can be guaranteed 100% secure, but we take unauthorized access and misuse seriously and use platform controls designed to protect galleries and customer data.


10) Children’s Privacy

OIS photographs minors through schools and youth programs and uses access-controlled galleries. If you are a parent or guardian and have a concern about an image or access, text OIS and we will review promptly.


11) Updates to This Policy

We may update this policy to reflect platform, service, or operational changes. The Effective Date will reflect the latest version.

Copyright Notice

All photographs, graphics, digital files, previews, and visual content created by Own It Sports are protected by United States copyright law and remain the exclusive intellectual property of Own It Sports unless otherwise stated in writing. Purchase of digital files grants a limited personal-use license only.

Unauthorized copying, screenshotting, scraping, AI training use, redistribution, or commercial use of images is strictly prohibited and may result in legal enforcement under applicable copyright law.

These Terms & Conditions apply to all Own It Sports (“OIS,” “we,” “us”) galleries, proofs, purchases, downloads, print orders, and website-based bookings.

1) Customer Support

For the fastest help with access codes, viewing, ordering, downloads, or technical issues, text Tonee at 303-917-6030.

Automated gallery and order notifications may be sent from 833-518-3966, which is not monitored for customer communication.

2) Gallery Access and Acceptable Use

Galleries are provided via a private link, access code, and/or account login. By using an OIS gallery, you agree not to:

bypass or attempt to disable preview protections
copy, screenshot, screen-record, scrape, or distribute proof images
share access credentials outside your household in a way that enables misuse

OIS may restrict gallery access or decline service when misuse is detected.

Galleries may be hosted on third-party platforms such as PhotoDay, and use of those galleries is also subject to the platform’s applicable policies and terms.


3) Edited-Only Workflow, Session Type, and Editing Credit

Own It Sports is a boutique, edited-only workflow.

OIS displays edited images in the gallery.

Individual images are edited and uploaded when the Editing Credit is submitted, per the instructions provided at registration/booking.

If Team Picture Only was selected, the gallery will show only the team photo for your athlete.

If you expected individual images and do not see them, text 303-917-6030 so we can confirm what was selected and what is required.


4) Gallery Technology, Face Recognition, and Proof Protection

Own It Sports may host galleries through third-party platforms such as PhotoDay.

Some galleries may use PhotoDay FaceFind, a facial recognition search feature that helps customers locate photos of a specific athlete by comparing facial characteristics within the gallery.

This biometric processing is performed by the gallery platform provider and is used solely to assist customers in locating images within the gallery.

Own It Sports does not maintain independent biometric databases and does not use facial recognition technology outside the functionality provided by the gallery platform.

Preview images may include protective measures designed to discourage unauthorized copying or redistribution. These protections may include:

watermarks
platform screenshot deterrence features
gallery preview protections

Own It Sports may also use third-party proof protection technologies such as SnapShield or similar services in the future.

These protections apply to preview images only. Purchased downloads and printed products are delivered clean.


5) Orders, Cropping, and Customer Review Responsibility

You are responsible for reviewing your order before submitting it, including:

product selection and quantities
crop/trim selections (when offered)
shipping address and recipient details
any custom options or text (names, numbers, banners, etc.)

Orders route into production after submission and may not be changeable.


6) Digital Downloads and License

All images remain the intellectual property of Own It Sports.

Digital purchases grant a personal-use license for personal printing and personal sharing.

You may not:

resell files or products
use images commercially (advertising, brand promotions, NIL/commercial collateral) without written permission
provide files to third parties (trainers, media outlets, vendors, organizations) for their marketing or resale

Digital downloads are final sale once delivered or made available for download.


7) Print Products and Fulfillment

Print products are produced through professional third-party labs.

Screen-to-print color variation can occur due to device settings and calibration. Minor variation is not considered a defect.


8) Refunds, Reprints, and Defects

No refunds for digital downloads.

No refunds after print products are received.

If there is a verified lab defect (damage or production error), OIS may offer a reprint or store credit after review of the issue and order details.


9) Website Bookings and Payments

OIS accepts bookings and collects information through our website.

Our website is HTTPS-secured.

Payment options offered on the website are processed through secure third-party payment providers, and payment details are handled by those providers’ checkout systems.


10) Portfolio Use and Opt-Out (Text-Based)

Unless you opt out, you grant OIS permission to use images for portfolio and marketing purposes, including website, social media, and printed samples.

OIS does not publish sensitive personal information.

Opt-Out:
Text OPT OUT to 303-917-6030 with the athlete’s name and program/team. OIS will apply this preference going forward.


11) Third-Party Platform Policies

Certain gallery services used by Own It Sports are provided by third-party platforms. When galleries are hosted through PhotoDay, customer use of the gallery may also be subject to PhotoDay’s policies.

12) Preview Protection Reference

13) Access Codes, Team Rosters, and Gallery Sharing

Gallery access codes and links are intended for the families of the athletes participating in the program or event.

Access codes may be distributed through schools, leagues, coaches, or program administrators to help families locate their athlete’s gallery.

Customers agree not to publicly post gallery access codes, distribute them in large public forums, or share them in a way that enables bulk downloading, scraping, or unauthorized commercial use of images.

Own It Sports reserves the right to change access codes, restrict access, or remove galleries if misuse or excessive distribution of access credentials is detected.


14) Artificial Intelligence (AI) and Machine Learning Restrictions

Images created by Own It Sports may not be used for artificial intelligence training, machine learning datasets, facial recognition training systems, or automated image-generation models without prior written permission.

This restriction applies to both preview images and purchased digital files.

Unauthorized use of images for AI training, dataset generation, scraping, or automated content generation is strictly prohibited.


15) Anti-Scraping and Automated Access

Customers may not use automated tools, scripts, bots, crawlers, or scraping technologies to access, download, copy, or collect images or gallery data.

Attempting to bypass gallery protections, watermarking, screenshot deterrence, or other platform protections may result in access restrictions and potential legal action.

Own It Sports reserves the right to block automated traffic, restrict suspicious activity, or terminate access to galleries if automated behavior is detected.
